In order to obtain a Swiss certificate of capacity to marry (for Swiss nationals), the following documents must be submitted:
- Form “Gesuch um Ausstellung eines Ehefähigkeitszeugnisses” (can be obtained at the Regional Consular Centre and must be signed by both the bride and the groom in the presence of an official at the Regional Consular Centre, from Monday to Friday, 09:00 am to 12:00 noon by appointment only (please contact firstname.lastname@example.org). If one of them lives in another country, the application has to be submitted via the competent Swiss representation abroad, or alternatively through the competent office of civil status in Switzerland;
- Forms “Erklärung betreffend die Voraussetzungen für die Eheschliessung” (can be obtained at the Regional Consular Centre and must be completed, dated and signed by the bride and the groom in the presence of an Regional Consular Centre official). If one of them lives in another country, the application has to be submitted via the competent Swiss representation abroad, or alternatively through the competent office of civil status in Switzerland;
- Certificate of civil status may have to be obtained for Swiss nationals. This can be ordered from your place of origin in Switzerland;
- Confirmation of registration with the Regional Consular Centre (can be issued over the counter for registered Swiss nationals);
- Birth certificate of the foreign fiancé/e, mentioning the parents’ names (photocopies cannot be accepted). If the Swiss national’s place of origin is in Canton Vaud, please note that this document must bear the Apostille of the Foreign and Commonwealth Office:
- Official document confirming the civil status of the foreign fiancé/e, legalised by Apostille. If no such document is available through the relevant Registrar, Embassy or Consulate, a statutory declaration signed before a notary public, mentioning the marital status and the address and bearing an Apostille of the Foreign and Commonwealth Office must be submitted:
- If the foreign fiancé/e is divorced or widowed, a divorce decree final and absolute or the death certificate of the former spouse (photocopies are not accepted) must be submitted. If the Swiss national’s place of origin is in Canton Vaud, the documents must bear the Apostille of the Foreign and Commonwealth Office:
- Confirmation of address of the future spouse (if such a document is not available through the relevant Embassy or Consulate, please bring a utility bill or include the information in the above-mentioned statutory declaration);
- The original passports of the couple.
The fee for the application will amount to £600.00 and it can be paid in cash or by cheque only.
If any documents of civil status have been issued outside the United Kingdom, please contact the Regional Consular Centre prior to submitting the documents in order to confirm the correct papers to be provided. Documents of civil status issued in a different country must be legalised by the competent Swiss representation. In some cases, the legalisation will be subject to an extra fee and can take several weeks.
As soon as all the above-mentioned documents are submitted, the certificate of capacity to marry should be available within approximately 6-8 weeks.
Please note that all documents of civil status (birth, marriage/civil partnership, divorce, death, certificate of no impediment/statutory declaration) must be newly issued. Documents older than 6 months will not be accepted.
Please note that in many European countries a certificate of civil status will enable Swiss nationals to get married without needing to obtain a certificate of capacity to marry. The authorities competent for your chosen place of marriage will advise if a certificate of capacity to marry is necessary.
